Terms of Service

1. Agreement to Terms

By accessing or using the Win Cities website at wincities.com (the "Site"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Site. Win Cities LLC ("Win Cities," "we," "us," or "our") is a Minnesota limited liability company.

2. Description of Service

Win Cities provides an online platform for sports card consignment services. We facilitate the listing and sale of consigned sports cards, trading cards, and related collectibles through our eBay store and other online marketplaces. Use of our consignment services is governed by our separate Consignment Terms and Conditions.

3. Account Registration

To use certain features of the Site, you must register for an account. When you register, you agree to:

  • Provide accurate, current, and complete information during the registration process
  • Maintain and promptly update your account information to keep it accurate and current
  • Maintain the security and confidentiality of your login credentials
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

You must be at least 18 years of age to create an account. We reserve the right to suspend or terminate any account at our sole discretion.

4. Acceptable Use

You agree not to use the Site to:

  • Violate any applicable law, regulation, or third-party rights
  • Submit fraudulent, counterfeit, or misrepresented items for consignment
  • Interfere with or disrupt the integrity or performance of the Site
  • Attempt to gain unauthorized access to any portion of the Site or its related systems
  • Use any automated means (bots, scrapers) to access the Site without our express written permission
  • Impersonate any person or entity, or falsely state or misrepresent your affiliation with any person or entity

5. Intellectual Property

The Site and its original content, features, and functionality are owned by Win Cities LLC and are protected by international copyright, trademark, and other intellectual property laws. Our trademarks, logos, and service marks may not be used in connection with any product or service without our prior written consent.

6. User Content

By submitting content to the Site (including item descriptions, images, and other information), you grant Win Cities a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display that content in connection with providing our services. You represent that you have the right to grant this license for any content you submit.

7. Payments and Fees

Commission rates, listing fees, and payout terms are described in our Consignment Terms and Conditions and on the Site. All fees are in U.S. Dollars. We reserve the right to change our fee structure at any time with reasonable notice. Payouts are processed via PayPal or ACH bank transfer as selected by you during account setup.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WIN CITIES LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE OR OUR SERVICES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT OF FEES PAID BY YOU TO WIN CITIES IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

9. Disclaimer of Warranties

THE SITE AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

10. Indemnification

You agree to indemnify, defend, and hold harmless Win Cities LLC, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorney fees) arising out of or in any way connected with your access to or use of the Site, your violation of these Terms, or your violation of any rights of another party.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Minnesota, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Hennepin County, Minnesota.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on this page with a revised "Last updated" date. Your continued use of the Site after any changes constitutes acceptance of the new Terms.

13. Termination

We may terminate or suspend your account and access to the Site immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Site will immediately cease. Any items currently consigned with us will be handled according to the Consignment Terms and Conditions.
