Win Cities LLC – Sports Card Consignment Terms & Conditions
Effective Date: December 2025
These Terms & Conditions (“Terms”) govern all consignments submitted to Win Cities LLC (“Win Cities,” “we,” “us,” or “our”). By shipping or delivering items to Win Cities for consignment, you (“Consignor,” “you,” or “your”) agree to the following:
1. Consignment Relationship
- Win Cities acts solely as a selling agent on your behalf.
- Title to all items remains with the Consignor until the item is sold and funds clear.
- Win Cities does not guarantee authentication, grading outcomes, or minimum sale prices.
- We reserve the right to refuse any item for any reason.
2. Eligible Items
2.1 We accept the following items for consignment:
- Sports trading cards (graded or raw)
2.2 We do not accept:
- Autographed memorabilia, jerseys, balls, or equipment
- Non-sports collectibles
- Counterfeit, trimmed, altered, or otherwise problematic items
2.3 All items must be authentic. If an item appears questionable, we may decline to list or return it at your expense.
3. Item Submission Requirements
- All raw cards must be in penny sleeves and top loaders or card savers.
- Graded cards must arrive in clean, intact slabs.
- Items must be packaged securely to avoid damage during transit.
- Include your consignment submission form inside the package.
- Win Cities is not responsible for damage caused during shipping to us.
4. Commission Rates & Fees
These rates include all eBay fees, payment processing fees, and shipping to the buyer. Your payout is the sale price minus the commission and listing fee.
4.1 Commission Structure:
- $0 – $100: 20%
- $101 – $1,000: 15%
- $1,001 – $3,000: 12%
- $3,001 – $5,000: 10%
- $5,001 – $10,000: 8%
- Above $10,000: 5%
4.2 A $0.99 per-card listing fee applies to each card listed for sale. This fee is deducted from the consignor payout in addition to the commission.
4.3 Commission and listing fees are deducted automatically from the final sale price.
4.4 Win Cities may automatically lot low-value items or combine duplicates if it improves sale quality.
5. Listing, Pricing & Sale Method
5.1 All items are listed at Win Cities' discretion, including:
- Auction format
- “Buy It Now” listings
- Starting price
- Duration
- Timing of listings
5.2 We do not guarantee a specific sale price, number of bids, or final outcome.
5.3 We may relist unsold items or include them in bulk lots when appropriate.
6. Payouts
- Payouts are issued after ALL items in a batch have sold and all payments have cleared. We do not issue partial payouts for individual items — your entire batch must be completed before payout is processed.
- A batch is considered complete when every item has either sold, been returned, or been otherwise resolved.
- Payments are sent via the chosen method on your account (PayPal, check, or ACH direct deposit).
- You are responsible for providing accurate payment information.
- Win Cities deducts returns, chargebacks, or disputes from consignor payouts.
7. Returns, Refunds & Chargebacks
- In the event a buyer returns an item, issues a claim, or files a dispute, the amount refunded is charged back to the Consignor, as Win Cities does not absorb losses on returned merchandise.
- Returned items may be relisted or returned to the Consignor at their expense.
8. Loss, Theft & Damage
- Win Cities takes reasonable care in storing and handling items.
- Win Cities is not liable for accidental loss, theft, fire, or damage, except in cases of gross negligence.
- Insurance beyond basic coverage is the responsibility of the Consignor.
9. Marketing & Media Use
Consignor grants Win Cities permission to use images, videos, and descriptions of consigned items in:
- Marketing materials
- Social media
- Website content
- Educational or promotional posts
No compensation is owed for such usage.
10. Unsellable, Low-Value, or Rejected Items
- Items determined to be unsellable, counterfeit, damaged, or of extremely low value may be returned to the Consignor at their expense, or donated or disposed of after 30 days if no instruction is provided.
- Win Cities may group low-value items into bulk lots to maximize sale outcome.
Tax Reporting: Consignors are solely responsible for reporting income received from the sale of their items. Win Cities LLC does not issue tax documents (including 1099 forms) to consignors, as sale proceeds remitted are funds belonging to the consignor, not payments for services.
11. Governing Law
These Terms shall be governed by and interpreted under the laws of the State of Minnesota, without regard to conflict-of-law principles.
12. Agreement to Terms
By submitting items to Win Cities LLC, you acknowledge and agree to these Terms & Conditions in full.
